Terms & Conditions

1. Scope of Services

TONIBAY Journeys curates and facilitates travel experiences, working with a network of trusted partners including transport providers, guides, attractions and activity providers. While we exercise due care in the selection of Service Providers, such services are ultimately rendered by independent parties.

2. Booking & Confirmation

Once we receive your enquiry, our team will contact you to arrange an initial consultation to understand your interests, travel style, and preferences for your Singapore journey.

Following the consultation, if you wish to proceed, an itinerary proposal fee equivalent to 5% of the total proposed package cost will be required. Once payment is received, our travel specialists will prepare and deliver a personalised tour proposal outlining your curated itinerary, recommended experiences, and the estimated package cost based on your requirements.

If you are satisfied with the proposal and wish to confirm your booking, a 30% deposit of the total package cost will be required to secure your reservation. The itinerary proposal fee previously paid will be credited towards this deposit, meaning you will only need to pay the remaining balance of the 30% deposit.

The remaining balance of the package cost must be paid in full at least 15 days prior to the commencement of your tour. Bookings are considered confirmed only upon receipt of the required payments. You are responsible for ensuring the accuracy and completeness of all information provided at the time of booking.

We accept payment via credit card and bank transfer.

3. Pricing & Payment

All prices are quoted in SGD unless otherwise specified. Tour prices are based on the itinerary, transporation and inclusions specified in the tour proposal. Prices are subject to change prior to confirmation due to availability, supplier adjustments or external factors. Full payment must be received within the stipulated timeline prior to the commencement of services. Payments are processed via secure third-party payment platforms. If payment is not received within 10 days of your scheduled start date, we reserve the right to cancel your tour without refunding the deposit.

4. Amendments & Cancellations

We understand that you may need to alter or cancel your tour for various reasons. If you need to change or cancel your tour, please contact us as soon as possible. All requests for amendments or cancellations must be submitted in writing. Amendments are subject to availability and may incur additional charges. Cancellation charges will apply in accordance with the timing of the request and the policies of relevant Service Providers. No refund shall be made for any unused portion of services once the journey has commenced.

If you need to cancel your booking, the cancellation schedule will be as follows:

• More than 10 days prior to departure: 50% of deposit is chargeable;
• 10 - 5 days prior to departure: 100% of deposit is chargeable;
• 5 - 2 days prior to departure: 50% of the tour price is chargeable;
• Less than 2 days prior to departure: 100% of tour price is chargeable and there will be no refund.

If the tour is cancelled due to weather, natural circumstances or the fault of the Company, a full refund will be issued excluding the initial non refundable deposit (Porposal Fee). The Company will make every effort to provide tours as scheduled, but it is understood that circumstances beyond our control can arise that may necessitate the cancellation of a tour. In such cases, we will provide a full refund as a gesture of good faith.

5. Changes to Itinerary

TONIBAY Journeys reserves the right to make reasonable modifications to itineraries where necessary due to operational requirements, weather conditions, safety considerations, or circumstances beyond our control. Where possible, suitable alternatives of comparable standard will be provided.

6. Travel Documentation & Compliance

You are solely responsible for ensuring that you possess:

• valid travel documentation including passports and visas
• comply with all applicable immigration, customs, health, and legal requirements

TONIBAY Journeys shall not be liable for any consequences arising from failure to meet such requirements.

7. Insurance

We strongly advise all customers to purchase appropriate travel insurance to cover any unexpected incidents or accidents that may occur during the tour. This can include coverage for medical expenses, trip cancellations, and lost or stolen property.

8. Liability

TONIBAY Journeys will not be held liable for any personal injury, death, or loss of personal property that occurs during the tour. Customers are responsible for their own personal safety and property, and should take appropriate measures to protect themselves and their belongings. In the event of any accidents or incidents that occur during the tour, the tour company will provide appropriate assistance and support to the affected party. However, the tour company will not be held liable for any costs incurred as a result of such incidents. It is important to note that the tour company reserves the right to make changes to the itinerary, routes, or other aspects of the tour as necessary, for reasons including but not limited to weather conditions, road closures, and other circumstances outside of the tour company's control. The tour company will not be held liable for any costs incurred as a result of such changes.

In the unlikely event of a tour being cancelled by the tour company, customers will receive a refund as per our cancellations fee mentioned in clause 4. Amendments & Cancellations.

By agreeing to these terms and conditions, customers acknowledge and accept the limitations of liability as outlined above. This helps ensure a clear understanding of the rights and responsibilities of both the tour company and the customers, and helps provide a safe and enjoyable experience for all participants.

9. Personal Conduct

TONIBAY Journeys urges and you agree to conduct yourself in a respectful and lawful manner throughout the duration of the services. We reserve the right to terminate or withdraw services, without refund, if your conduct is deemed to endanger the safety or well-being of yourself or others and disrupt the integrity of TONIBAY Journeys or our Service Providers.

10. Privacy & Data Protection

Your personal data is collected, used, and disclosed in accordance with our Privacy Policy and the Personal Data Protection Act 2012 (Singapore).

11. Intellectual Property

All itineraries, proposals, and materials provided by TONIBAY Journeys remain our intellectual property. They may not be reproduced, distributed or used for commercial purposes without our prior written consent.

12. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Singapore, if prior attempt to resolve the dispute through friendly and informal negotiations fail.
